The Paseo Village Development
In December 1976, home builders, Lambert & Winton broke ground on a new community within the Santa Teresa Country Club area known as “Paseo Village."
Since 1977 our Covenants and By-Laws have only been updated 1 time each 2010 and 1981 respectively. Fortunately, they were well written from the start. To keep them current with the times (and New Mexico Laws) a committee was organized four years ago to modernize them. In 2021 the Board received bids from $8,000 to $12,000 from law firms to provide new Covenants and By-Laws, but those amounts were determined not to be in the Paseo Village budget. So, the Board, Committee and Community made the decision to compile our own community documents (following other NM HOA associations), then vote for them as a community, and afterwards have a law firm that specializes in "Community Documents" do a review. The Board and Committee finished compiling, the Community voted, and the law firm Turner Law of Albuquerque completed their review. Unfortunately, the new By-Laws were approved but the Covenants did not have the required 75% of homeowner’s approval. While Turner Law Firm was reviewing our community documents it was determined the 2010 Covenants were not valid and thus, unenforceable because they were not written, worded or typed correctly nor reviewed by an attorney. When asked if we had any proof of even voting in 2010; a search found none. Thus, our only recourse was to revert to the previous 1979 version which were completed by an attorney, and do not have typos and errors. Our attorney, Turner Law Firm, recommended we move the only change in 2010, the new architectural changes, into the new Rules and Regulations manual; the Board approved that recommendation at the April 7th, 2022, Board Meeting.
